Terms of Service

These Terms govern access to and use of EPR Clear (the "Service"). By using the Service you agree to them; if you use the Service for an organization, you accept them for that organization and confirm you are authorized to do so.

1. Who we are

The Service is provided by Athanix OÜ ("EPR Clear", "we", "us"), which is the party you contract with. Our registration details and registered office are on the Imprint.

2. The Service

EPR Clear checks marketplace sellers' EPR registration numbers against national producer registers, per waste stream and per member state, monitors for changes such as revocations, and writes checks into a timestamped evidence log. Features vary by plan and evolve as registers and regulations do.

3. Verification standard

Verification evidence under best-efforts standard; registers remain the authoritative sources. A verdict states what the named register showed at the time of the check. "Registered" or "verified" means the register showed an active registration; it does not certify that a seller is compliant with its wider EPR obligations. The registers remain the authoritative sources, and we do not guarantee that a register itself is accurate, complete, or current. The Service provides verification evidence, not legal advice.

4. Accounts and access

Sign-in is passwordless, by magic link to your email. You are responsible for activity under your account and for protecting the inbox that receives your sign-in links. You must be authorized by your organization to load its seller data.

5. Acceptable use

You agree not to:

• use the Service to harass sellers, or for any purpose other than compliance verification and the record keeping connected to it;
• probe, scan, or disrupt the Service, or access it other than through its interfaces and documented APIs;
• resell or republish register data obtained through the Service as a data product of your own;
• misrepresent verification results, or present them as issued by a register or authority.

6. Your data

Seller lists and verification workspaces you load remain yours. We process them only to provide the Service, as described in the Privacy Notice at /privacy. You are responsible for having the right to submit the seller data you load.

7. Plans and billing

Single lookups on the public checkers are free and need no account. Paid plans are billed through our payment processor, Stripe: the Platform tier per seller-check with platform minimums, and the Partner tier by agreement, in each case at the price and on the billing cycle shown at the point of order. Subscriptions renew automatically until cancelled; you can cancel at any time and keep access through the end of the paid period. We are not currently subject to VAT collection. Where taxes apply to your purchase, Stripe computes them automatically from your billing location and they appear at checkout. Except where required by law, payments are non-refundable.

8. Intellectual property

The Service, its software, design, and the EPR Clear brand belong to us and our licensors. These Terms grant you no rights in them beyond using the Service. Register data belongs to its publishers and is reused under their terms, with attribution where required.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law, including fitness for a particular purpose and non-interruption. Section 3 states the standard the verification evidence is produced under.

10. Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total aggregate liability arising out of the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or one hundred euros. Nothing here excludes liability that cannot be excluded under applicable law.

11. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or use that creates risk or legal exposure. On termination you may export your workspace data for a reasonable period, except where we must retain or delete it by law.

12. Changes

We may update the Service and these Terms as the product and the regulations evolve. Material changes are announced to account holders; continued use after they take effect is acceptance.

13. Governing law

These Terms are governed by the laws of Estonia (European Union), without regard to conflict-of-laws rules, and the courts of Estonia have jurisdiction, without prejudice to mandatory consumer protections where they apply and any right they give you to bring proceedings in your country of residence.
